These Terms and Conditions set out the basis on which Rubbish Clearance Bow provides rubbish removal and waste collection services to domestic and commercial customers in Bow and surrounding areas. By booking a service, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and Rubbish Clearance Bow.
In these Terms and Conditions the following expressions have the meanings set out below:
Customer means any individual, business, company or organisation booking or receiving services from Rubbish Clearance Bow.
Services means any waste collection, rubbish removal, bulky waste disposal, clearance or related services provided by Rubbish Clearance Bow.
Waste means any items, materials or substances presented for collection that are not excluded under these Terms and Conditions or applicable waste regulations.
Contract means the agreement between the Customer and Rubbish Clearance Bow incorporating these Terms and Conditions and any written quotation or booking confirmation.
Rubbish Clearance Bow provides rubbish removal and waste collection services, including but not limited to domestic clearances, garden waste clearance, office and commercial waste removal, and bulky item collection. The exact scope of the Services will be described in the quotation or booking confirmation.
All Services are subject to availability and to site access, safety and compliance with relevant waste regulations. Rubbish Clearance Bow reserves the right to refuse any job or part of a job where it would be unsafe, unlawful or impractical to proceed.
The Customer may request a quotation by telephone, email or online enquiry, providing accurate information about the type and volume of rubbish to be cleared, the collection address, access conditions, parking availability and any relevant time constraints.
Quotations are based on the information provided by the Customer and may be revised if, on arrival, the volume, nature or location of the waste differs from that described, or if access and parking conditions are not as stated.
A booking is confirmed only when Rubbish Clearance Bow has issued a verbal or written confirmation and the Customer has accepted the quotation and proposed service date and time. In some cases, a deposit may be required to secure the booking.
The Customer must ensure that an authorised person is present at the collection address at the agreed time to provide instructions, grant access and approve any changes to the agreed scope or price of the Services.
The Customer is responsible for providing safe and reasonable access to the waste to be collected, including appropriate arrangements for parking any vehicles required for the clearance.
Where parking charges, permits or restrictions apply, the Customer must inform Rubbish Clearance Bow at the time of booking and is responsible for any parking costs incurred in relation to the provision of the Services, unless otherwise agreed in writing.
If access is restricted or unsafe, or if the team is unable to park within a reasonable distance of the collection address, Rubbish Clearance Bow may apply additional charges for extra time, labour or walking distance, or may cancel the job and apply a call-out charge.
Rubbish Clearance Bow collects most common household, garden and commercial waste, including general rubbish, furniture, appliances and non-hazardous materials.
Certain items cannot be collected or may require special arrangements, including but not limited to hazardous waste, medical waste, asbestos, gas bottles, chemicals, solvents, oils, paint, tyres, explosives, pressurised containers and any material classified as hazardous under UK law.
The Customer must disclose in advance any waste that may be hazardous, difficult to handle or subject to specific disposal regulations. Rubbish Clearance Bow reserves the right to refuse to handle any prohibited or hazardous items, or to charge additional fees where specialist handling and disposal are required and agreed.
Prices are usually based on the estimated volume, weight, type of waste and the labour involved in loading, along with any additional costs for access, parking and disposal.
Any quotation provided before attendance is an estimate only, based on the information supplied. The final price will be confirmed on site once the team has inspected the waste and assessed the work required.
Where the amount or nature of waste exceeds that originally described, or there are delays or complications outside the control of Rubbish Clearance Bow, additional charges may apply. Any such changes will be explained to the Customer before work proceeds.
Unless otherwise agreed in writing, payment is due in full immediately on completion of the Services on the day of collection.
Rubbish Clearance Bow may accept payment by cash, debit or credit card, bank transfer or other payment methods notified to the Customer. Where payment is made by card or online, appropriate security and verification measures may apply.
For business Customers, account facilities or payment terms may be agreed in advance at the sole discretion of Rubbish Clearance Bow. Invoices must be paid by the due date specified. Late payment may incur interest and reasonable costs of recovery.
Title to any waste removed passes to Rubbish Clearance Bow only when payment has been received in full, subject to compliance with waste transfer and duty of care requirements.
The Customer may cancel or reschedule a booking by contacting Rubbish Clearance Bow as soon as possible and in any event no later than 24 hours before the agreed arrival time.
Where a booking is cancelled with less than 24 hours notice, Rubbish Clearance Bow reserves the right to charge a reasonable cancellation fee to cover administration, scheduling and any travel or staffing costs incurred.
If the Customer is not present at the agreed time, or if access is not available and the team is unable to complete the collection, this may be treated as a late cancellation and a call-out or cancellation fee may be charged.
Any request to change the scope, location or timing of the Services is subject to availability and may result in a revised quotation or additional charges.
Rubbish Clearance Bow will make reasonable efforts to arrive within the time window agreed with the Customer. However, all times are estimates and may be affected by traffic, weather, previous jobs and other circumstances beyond reasonable control.
Rubbish Clearance Bow will not be liable for any losses, costs or damages arising from early or late arrival, provided that reasonable efforts are made to keep the Customer informed of significant delays.
The Customer must ensure that all waste for collection is clearly identified and accessible, and that no items are removed which the Customer intends to keep.
The Customer is responsible for obtaining any permissions or consents required for access to shared areas, private roads, managed premises or commercial sites.
Where disassembly of items or minor dismantling is requested, this will be carried out only where safe and practical to do so, and the Customer accepts that this may cause minor damage to fixtures or fittings which will not be the responsibility of Rubbish Clearance Bow unless due to negligence.
Rubbish Clearance Bow will exercise reasonable care and skill in providing the Services. However, the Customer acknowledges that waste clearance is a manual and sometimes heavy-duty process.
Rubbish Clearance Bow will not be liable for any pre-existing damage to property, fixtures, fittings, surfaces, driveways or access routes, or for any damage that could not reasonably be avoided while carrying out the Services in a careful and competent manner.
Any claim for loss or damage must be reported to Rubbish Clearance Bow in writing as soon as reasonably practicable and in any event within 7 days of completion of the Services, providing reasonable details and evidence.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
Subject to the above, the total liability of Rubbish Clearance Bow arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for the relevant Services.
Rubbish Clearance Bow operates in accordance with applicable UK waste regulations and environmental legislation. All waste collected will be transported and disposed of at licensed facilities wherever required by law.
Where appropriate, waste transfer documentation will be completed to evidence the lawful transfer of waste from the Customer to Rubbish Clearance Bow or to any authorised third-party facility or contractor.
The Customer agrees not to request or require any service that would involve unlawful dumping, fly-tipping or breach of duty of care obligations. Rubbish Clearance Bow may refuse any request that is incompatible with legal or regulatory requirements.
Rubbish Clearance Bow aims to minimise the amount of waste sent to landfill by separating materials for reuse and recycling where reasonably practicable.
No guarantee is given that any particular item will be recycled, reused or donated, but Rubbish Clearance Bow will apply reasonable efforts to manage waste in an environmentally responsible manner consistent with operational and regulatory constraints.
Rubbish Clearance Bow maintains appropriate insurance cover for public liability and for its own vehicles and personnel, as required for the provision of waste collection and rubbish clearance services in the UK.
Details of insurance cover can be provided to Customers upon reasonable request.
If the Customer is dissatisfied with any aspect of the Services, they should contact Rubbish Clearance Bow as soon as possible to allow the issue to be investigated and, where appropriate, remedied.
Rubbish Clearance Bow will handle complaints in a fair and timely manner and may request additional information, photographs or access to the site to assess any issues raised.
Rubbish Clearance Bow will collect and process personal information only to the extent necessary to manage bookings, provide Services, take payment and handle any queries or complaints.
Customer information will be kept secure and will not be sold to third parties. Information may be shared with service partners or authorities where required for operational, legal or regulatory reasons.
Rubbish Clearance Bow may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to the relevant Contract.
Any changes intended to apply to ongoing or future services will be published or otherwise notified to Customers where appropriate.
Rubbish Clearance Bow will not be liable for any delay or failure to perform the Services where such delay or failure is caused by events beyond its reasonable control, including but not limited to extreme weather, natural disasters, accidents, strikes, road closures, fuel shortages or acts of government.
These Terms and Conditions and any dispute or claim arising out of or in connection with them or with the Services shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Clearance Bow.
If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
These Terms and Conditions, together with any written quotation or booking confirmation issued by Rubbish Clearance Bow, constitute the entire agreement between the parties in relation to the Services and supersede any previous understanding, arrangement or statement, whether oral or written.
No variation of the Contract will be valid unless agreed in writing by an authorised representative of Rubbish Clearance Bow.
